What is a Confidential Marriage License in California?

Many times an engaged couple will call me confused about what is a confidential marriage license, exclaiming that they want to be married legally. Of course, that is the goal.

From my many years of experience as an attorney, a specialized notary, a wedding officiant and a married man, I highly recommend a California confidential marriage license. Why? Well, there are many reasons, and mainly it’s about privacy. In today’s world of identity theft and telemarketing, I strongly recommend it. It will protect your personal information and that of your parents. Yes, it’s true.

A confidential marriage license in California is really, the only way to go to protect yourself. Many couples question it’s legality, but it’s completely legal, as long as it’s issued correctly, which is something I am noted for by the Los Angeles County Clerk’s office. It’s just protected from prying eyes. The only way anyone can view your marriage license is with a court order.

The Wedding Laws

I get many calls each month from couples who want to bypass a wedding ceremony and just be married. I also get calls from couples who didn’t know that in order for them to be married legally they need to be issued a marriage license. I also talk to couples who say that they don’t want to have a confidential marriage license because that means they wouldn’t be married legally. I’m posting this wedding information to put an end to erroneous assumptions such as these.

Here it is in a nutshell:

You must first obtain a marriage license to get married which issued through the County Recorder’s office. I can supply that for you so that you don’t have to spend half your workday navigating through the system.
You must have your marriage solemnized by an authorized wedding officiant. That’s a fancy way of saying that you have to have a wedding ceremony. I can also perform your wedding ceremony for you. Now some people aren’t the big wedding ceremony types and I can make the wedding ceremony as big or little as you want. I have often married people in restaurant booths, coffee houses and their houses. Your ceremony can be as long or short as you wish as long as I cover a couple of basic wedding laws.
Your officiant must file the signed and filled out marriage license after your wedding ceremony. And it must be correctly filled out or the county will probably reject it. I’m an attorney, so paperwork is second nature to me and knowing that the mail systems can be unreliable and slow, I hand deliver all of my marriage licenses to the County Clerk’s office.
The California Confidential Marriage License, the one that I am authorized by Los Angeles County to issue, is completely legal. If I were getting married today (and I won’t because I am happily married) I would get this type of marriage license. Why? Because of identity theft and telemarketers. The other type of marriage license is a Public marriage License, as in THE PUBLIC can see all the information that you list on it including your birthdate, your parent’s names, and your residence address. Elope

There are so many reasons to elope. Here are some of the reasons I’ve come across in talking to many couples and providing them with a private, confidential wedding and a confidential marriage license:

Elope for a tax break. (If it’s the end of the year and you know you’re going to get married soon, why not get a write off on your income tax?)

Elope for insurance purposes. (If you’re getting married soon anyway and your fiance’s insurance is running out, why not make it legal ahead of that wedding for friends and family?)

Elope to stay in the country (If you are getting married soon anyway and time is running out on that visa, marry now. However, you must be in love and this must be a real marriage in order for your legal residency to happen.)

Elope before a deployment or work transfer. (Do you need a quick, impromptu wedding because of your circumstances? Then I can help you elope in Southern California.

Elope because you never got around to it. (I have married many couples who have been living together so long that everyone thought they were married. I understand, I’ll be there and nobody will know.)

Elope due to illness or accident. (Don’t wait. Life is too short.)

Elope to avoid the hassle and expense of a traditional wedding.

Elope for privacy. (You don’t have to be a celebrity to want to keep things just between the two of you.)

Elope because it’s fun. (It is!)

Wedding Candles for Beach Weddings

One wedding idea that is common is the use of wedding candles during a wedding ceremony. Many brides and grooms who get married in beach weddings often want to light a unity candle during the wedding ceremony. A unity candle is a wedding tradition that is usually done indoors.

My experience is that the windy atmosphere of a beach wedding does not mix with the fragile flame of a unity candle. Many of my clients who ignore my wedding advice NOT to light a unity candle outdoors often have to fake it when the flame of the candle ultimately goes out. There have been those couples who thought they had it figured out by buying a long necked main candle holder to protect the flame, however, when trying to grab the flame with the smaller candle, that smaller candle flame will often meet it’s demise or the couple will burn their hands trying to dip into the long candle holder. Even more awkward is when you must use a long necked lighter to frantically light the candle. This is not the feeling that most people want during their perfect wedding.

In my opinion, if you want to include a ceremony addition during a beach wedding there is an easier wedding tradition: a sand ceremony. I have done many wedding sand ceremonies and the mix of the wind and the sand is very dramatic. Also, what is wonderful, if you choose a beautiful container and your favorite colors of sand, you can have a nice wedding vessel as a great memory of your wedding.

I’d like to clarify some misconceptions about a Confidential Marriage License vs. a Public Marriage License.

Many people I talk to think that the Confidential Marriage License is not a valid license, but that is not the case. The only thing that a Confidential Marriage License does it protect your marriage license information from public view. As it is right now, ANYONE can view your personal information on a Public Marriage License and the county has the ability to sell that information to database companies.

Marriage License Los Angeles County

The Los Angeles County Recorder, also known as the L.A. County Clerk, is a very busy place. All kinds of people go there to get many sorts of things such as marriage licenses and other legal documents. It’s a very large place and yet, every time that I go there to file a marriage license so that a marriage certificate can be issued or to pick up marriage licenses I usually see a long line that looks like this:

It’s not an exciting place, but it’s a necessary one. If you are having a Southern California wedding then you need a marriage license first before you get married so obtaining a marriage license is necessary either at the County Clerk’s Office or through one of the few specially trained notaries available, such as myself.

There are only eight County Clerk’s offices in Los Angeles and over 10 million people living here. And all but one office closes at 3 pm. The other one stays open until 4 pm. Do the math and you can imagine what I come across when I make the trip every week. There are just way too many people and the parking lot is overcrowded and confusing. It is unquestionably a very frustrating experience. Most of my clients feel that way too so they ask me to issue their license so they can avoid such an ordeal.

Those who choose to get a Los Angeles marriage license themselves usually tell me that they regret it because it eats up most of a work day and both bride and groom must show up together during limited business hours. Taking the day off of work can sometimes be a costly thing especially when you are planning a honeymoon together and need that extra time for fun.
